Federal legislation was passed in 2006 that began requiring most non-profits, regardless of gross income, to file at minimum a 990-N (e-postcard) annually. We began notifying local units at that time. The law provides that any organization not filing for three consecutive years will automatically lose its tax exempt status.

The IRS will soon begin revoking the tax exempt status of all organizations required to file that have not filed for the past three years. This could significantly impact local PTAs. We have worked very hard annually to ensure local units are filing. Now is a time to intensify those efforts. Below are a series of articles/resources on this topic.

We call your attention to a recent article in the New York Times: http://www.nytimes.com/2010/04/23/us/23exempt.html

Detailed information from the IRS: http://www.irs.gov/charities/article/0,,id=217087,00.html

Does my organization have to file the e-Postcard if it is a subordinate organization in a group exemption?
http://www.irs.gov/charities/article/0,,id=177799,00.html

Finally, below is the IRS page for non-profits that we recommend all state leaders bookmark as a reference tool:
http://www.irs.gov/charities/index.html
